  1. About these Terms
    1. These terms and conditions (the “Terms”) apply to your access to and use of the Freesat website, located at freesat.co.uk (the "Site").
    2. The Site is owned and operated by Everyone TV Devices Limited, a company incorporated in England and Wales (registered number 6250097) whose registered office is at Triptych Bankside (North Building), 185 Park Street, London, SE1 9SH  ("Freesat", “we”, our”).  Our VAT number is 916 9787 65.

    4. By using the Site you agree to be bound by these Terms, which shall take effect immediately on your first use of the Site. If you do not agree to be bound by all of the Terms please do not access or use the Site.
    5. Freesat may change these Terms from time to time, including, for example, to reflect changes to our products and services, or to accommodate our business or users’ needs and so you should review these Terms regularly. Your continued use of the Site will be deemed acceptance of the updated terms.
  2. Other terms may apply
    If there is any conflict between these Terms and specific local terms appearing elsewhere on the Site (for example, Privacy Notice, Cookie Policy, Freesat Mobile App Terms) then the latter shall prevail.
  3. Your use of the Site and your Freesat account
    1. You may access the Site without registering your details with us, but some areas of the Site, or some features or functionality, may only be accessible if you register for a Freesat account (sometimes referred to as a Freesat ID). If so, those restricted areas, or features or functionality, may be subject to additional terms. If you register a Freesat account via the Freesat mobile app, or use a Freesat account with the Freesat mobile app, then the Freesat Mobile App Terms will apply to your use of the app.
    2. When you register an account, you must treat your password, or any other piece of information provided as part of our security procedures, as confidential. We have the right to disable any password or Freesat account at any time, if in our reasonable opinion you have failed to comply with any of these Terms.
    3. Our Site is directed to people residing in the United Kingdom, as the Freesat satellite TV service and Freesat-branded products are intended for UK residents only.  We do not represent that content available on or through our Site is applicable or appropriate for use in other locations.
    4. You agree not to use the Site (or any part of it) to:
      1. Obtain personal information, email addresses, contact information, passwords or other personally identifying information;
      2. Provide false or misleading information about yourself or your business, or create a false identity or use or attempt to use another’s account or identity; or
      3. Infringe the rights of anyone else.
    5. You will not do anything that affects the operability or security of the Site, including:
      1. placing (in our sole discretion) an unreasonable or disproportionately large load on our IT infrastructure;
      2. copying or modifying the HTML code used to generate web pages on the Site;
      3. using any device, software, or procedure that interferes with the proper working of the Site, or otherwise attempt to interfere with the proper working of the Site;
      4. taking any action that imposes, or may impose in our sole discretion, an unreasonable or disproportionately large load on our IT infrastructure;
      5. modifying, adapting, translating or reverse engineering any portion of the Site; or
      6. disrupting or otherwise interfering with the Site or the networks or servers we use.
  4. Intellectual property
    1. All intellectual property rights (registered and unregistered), including copyright, trade mark and database rights, in and on the Site and all content (including all applications) located on the Site shall remain the property of Freesat or its licensors.
    2. You are permitted to access, print and download webpages from the Site for your own private use, but not for any commercial or public use. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way and you must not use any photographs, video or audio sequences, graphics, logos or symbols separately from any accompanying text.
    3. You undertake not to distribute, transmit, re-transmit, broadcast or show in public any part of the Site or its contents without our prior written permission.
    4. The names, images and logos identifying Freesat or third parties and their products and services in any content published on the Site are subject to copyright, design and/or trade mark rights belonging to Freesat and/or third parties. You are not permitted to use any such rights except as described in this section.
    5. All other rights in and to the Site and the Site content are reserved to Freesat and/or its licensors.
  5. Linking to the Site
    1. If you would like to link to our Site, you may only do so on the basis that you link to, but do not replicate, the home page of the Site, and subject to the following conditions:
      1. you do not remove, distort or otherwise alter the size or appearance of the FREESAT logo;
      2. you do not create a frame or any other browser or border environment around the Site;
      3. you do not in any way imply that Freesat is endorsing any products or services other than its own;
      4. you do not misrepresent your relationship with Freesat nor present any other false information about Freesat;
      5. you do not use the link to damage our reputation or take advantage of it;
      6. you do not link from a website that is not owned by you;
      7. your website does not contain content that is distasteful, offensive or controversial, infringes any intellectual property rights or other rights of any other person or otherwise does not comply with all applicable laws and regulations.
    2. Freesat expressly reserves the right to revoke the right granted above at any time at our sole discretion and to take any action it deems appropriate.
  6. Third party websites
    Where our Site contains links to other websites and resources provided by third parties, these links are provided for your information only. Freesat is not responsible for the content of any third party websites that are accessible through the Site. Any links to third party websites from the Site do not amount to any endorsement of that website by Freesat and your use of that website is at your own risk.
  7. No warranty
    1. While Freesat tries to ensure that information provided by Freesat on the Site is correct at the time of publication, it is possible that the information may be incomplete, contain errors or be out of date. Therefore, to the extent permitted by law, Freesat disclaims any and all warranties, whether express or implied, statutory or otherwise as to the accuracy of any information contained on the Site.
    2. While Freesat tries to ensure that the Site and its functions operate correctly and remain available, Freesat cannot promise that this will always be the case. For instance, the Site may be suspended temporarily and without notice in case of system failure, maintenance or updates, or for reasons beyond Freesat's control. Therefore, to the extent permitted by law, Freesat does not warrant that (i) the Site or functions of the Site will be uninterrupted or error free; (ii) defects will be corrected; (iii) the Site, functions of the Site will be free of viruses or bugs; or (iv) the Site or functions of the Site will be of satisfactory quality or fit for a particular purpose.
    3. Different limitations and exclusions of liability will apply to liability arising as a result of the provision of any goods or other services to you by Freesat, which will be set out in applicable terms and conditions relating to the provision of such goods or services.
  8. Liability
    1. Nothing in these Terms limits or excludes Freesat's liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or in respect of any liability which cannot be excluded or limited under applicable law.
    2. Subject to Section 8.1, Freesat shall not be liable for any loss or damage whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with the use of, or inability to use, the Site or its functions, or use of or reliance on any information  or content displayed on the Site. In particular, Freesat will not be liable for (a) loss of revenue or anticipated profits; (b) loss of business; (c) loss of opportunity; (d) loss of goodwill or injury to reputation; (e) losses suffered by third parties; or (f) any indirect, consequential, special or exemplary damages.
  9. General
    1. If any provision of these Terms is determined to be invalid or otherwise unenforceable, such provisions shall be severed and deleted from these Terms and the remainder of these Terms shall continue to have full force and effect.
    2. The failure or delay of Freesat to exercise or enforce any right in these Terms does not waive Freesat's right to enforce that right.
    3. These Terms, their subject matter and their formation, are governed by English law. The courts of England and Wales will have exclusive jurisdiction except that if you are a consumer resident in Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a consumer resident in Scotland, you may also bring proceedings in Scotland.
